Bankruptcy Counsel on the Card, Banking, and PPX Legal team in
Capital One’s Legal Department, the attorney in this position will
work closely with a number of Capital One’s bankruptcy operations
teams within the business lines, Compliance, and across the Legal
Department to provide legal guidance, to ensure compliance with
internal policies and procedures and bankruptcy laws and
regulations, and manage litigation risk. The Bankruptcy Counsel
will serve as the primary bankruptcy counselor advising Capital
One’s Financial Services’s (FS) and Retail Bank/Small Business Bank
bankruptcy operations groups and related support groups and be
responsible for providing strategy and overseeing various
bankruptcy issues relating to auto loans, including, but not
limited to, automatic stay, lien perfection, proofs of claim,
dischargeability and other secured transaction litigation, along
with other consumer regulatory areas and bankruptcy litigation for
the business line operations they support. The Bankruptcy Counsel
will work closely with one other Bankruptcy Senior Counsel
supporting Capital One’s Consumer and Small Business Card, and
Commercial businesses and other support groups to help advise on
and implement best practices at an enterprise level. This role
requires an attorney with experience in business and/or consumer
regulatory and bankruptcy law, preferably Chapter 7, Chapter 11, or
Chapter 13 related litigation. The role requires an attorney with
intellectual curiosity, a desire to learn new areas of law, and an
interest and an ability to analyze and interpret laws, regulations,
and other source documents covering many different areas of the
law. This role also requires an attorney with a strong interest and
proficiency in the use of modern technology, and with strong
analytical, organizational, and prioritization skills.
Additionally, this role requires an attorney possessing excellent
verbal and written communication skills, attention to detail, the
ability to interact with and influence associates across
departments and job levels, and the ability to work effectively in
a fast-paced environment, with minimal supervision, while managing
large volumes of work including complex legal issues that may arise
suddenly. Job Responsibilities: Serve as the legal counselor
advising Capital One FS and Retail Bank/Small Business Bank
bankruptcy operations, and related support groups (e.g., Legal,
Compliance, Risk, Audit, and Quality Assurance) Support the
bankruptcy operations groups as an integral member of their
operational and risk management processes Provide strategic and
proactive leadership on trending legal and regulatory issues
affecting the supported businesses Ensure timely identification,
mitigation, resolution and reporting/escalation of existing and
emerging legal issues and risks Support the development, marketing,
and rollout of new products, services, and other innovations
impacting customers being serviced by the supported bankruptcy
operations groups Review internal policies and procedures and
advise Capital One’s bankruptcy operations groups on best
practices, policies and procedures Build and maintain effective
working relationships with internal and external stakeholder groups
If not located in Plano, Texas, travel to Plano will be required at
least quarterly and perhaps more frequently initially to build
relationships A successful candidate will have: Deep expertise in
commercial and/or consumer bankruptcy laws and regulations
affecting secured auto loans, unsecured loans, lines of credit, and
other banking products and services Financial services industry
knowledge and expertise, including experience with business and/or
consumer regulatory requirements relating to auto loans, credit
cards, lines of credit, loans, and other banking products and
services Ability to work in a fast-paced environment with minimal
supervision Ability to manage a large volume of work, including
complex legal issues that may arise suddenly Ability to thrive in
an environment primarily defined by close collaboration with the
businesses and Legal and Compliance colleagues to solve complex
legal issues and to develop and effectively communicate guidance
and advice Ability to think creatively about how to most
effectively and efficiently deliver legal advice and improve
current processes Ability and willingness to work as a team player,
with comfort interacting with associates across departments and job
levels, both inside and outside the Legal department Basic
Requirements: Juris Doctor from an accredited law school Active
member in good standing of at least one state bar At least 3 years
of experience as an attorney in a law firm, at a government agency,
as a military judge advocate or as in-house counsel At least 3
years of experience working with business or consumer bankruptcy
laws within the banking and financial services industry Preferred
Requirements: 4 years of law firm, in-house legal department,
Chapter 7 or Chapter 13 trustee representation, bankruptcy
restructuring, secured transactions, or government experience in an
attorney role 3 years of experience working on commercial or
consumer regulatory matters 3 years of experience as an attorney
within a regulatory environment Knowledge of consumer and
protection laws, including TILA, ECOA, UDAAP, FCRA, FDCPA, SCRA,
Dodd-Frank Act, and other accompanying regulatory consumer lending
regulations Experience with Google Workspace At this time, Capital

this job posting. The minimum and maximum full-time annual salaries
for this role are listed below, by location. Please note that this
salary information is solely for candidates hired to perform work
within one of these locations, and refers to the amount Capital One
is willing to pay at the time of this posting. Salaries for
part-time roles will be prorated based upon the agreed upon number
of hours to be regularly worked. McLean, VA: $164,800 - $188,100
for Manager, Counsel Plano, TX: $149,800 - $171,000 for Manager,
Counsel Richmond, VA: $149,800 - $171,000 for Manager, Counsel
Riverwoods, IL: $149,800 - $171,000 for Manager, Counsel Candidates
hired to work in other locations will be subject to the pay range
associated with that location, and the actual annualized salary
amount offered to any candidate at the time of hire will be
reflected solely in the candidate’s offer letter. This role is also
eligible to earn performance based incentive compensation, which
may include cash bonus(es) and/or long term incentives (LTI).
Incentives could be discretionary or non discretionary depending on
